Court Of Appeals Can Tell City To Follow Process, Obey Law Protecting Historic Districts

The Minnesota Court of Appeals is currently considering an appeal filed by the National Trust for Historic Preservation, the Preservation Alliance of Minnesota, and the Friends of the Riverfront. It is an appeal of the Minneapolis City Council's decision to overrule the unanimous Minneapolis Heritage Preservation Commission and allow a privately-built football stadium to destroy a 140-year-old street in a national historic district.

In a separate case, a Hennepin County District Judge dismissed a suit because she said her court did not have jurisdiction. She did not rule on the merits of the case. The Court of Appeals case is still pending. The Minneapolis Planning Commission, the Minneapolis City Council, the Metropolitan Parks and Open Space Commission and the Metropolitan Council all still have the opportunity to act to in the public interest protect the historic and natural resources of the St. Anthony Falls Historic
